Terms & Conditions
Effective Date: April 4, 2026
Welcome to ListWithFlex.com. These Terms and Conditions govern your purchase and use of our flat-fee MLS listing services. By purchasing a listing package, you enter into a binding agreement with Florida Flex Realty, a licensed Florida real estate brokerage.
1. Description of Service (The "$99 Flat-Fee Listing")
ListWithFlex provides a "Limited Service" listing. For a one-time administrative fee of $99, we provide:

MLS Entry: Submission of your property data into the local Florida Multiple Listing Service (MLS).

Digital Syndication: Pushing your listing to national portals including Zillow, Realtor.com, Redfin, and Trulia.

Standard Paperwork: Access to state-required disclosure forms and e-sign compliance tools.
2. "Limited Service" Disclosure (Florida Law)
Under Florida law, this is a Limited Service Listing Agreement. You acknowledge and agree to the following:

No Full Representation: Florida Flex Realty is not providing "Full Service" representation. We do not physically show your home, host open houses, or provide professional photography.

Transaction Broker Status: We act as a Transaction Broker, providing limited representation to a buyer, a seller, or both, but not representing either in a fiduciary capacity or as a single agent.

Direct Communication: You will handle all inquiries from buyers and agents directly.
3. Seller Obligations & Accuracy
You are the "Expert" on your own home. By using our service, you agree:

Data Accuracy: You are solely responsible for the accuracy of all information (square footage, room counts, etc.) provided to the MLS. Florida Flex Realty is not liable for errors in your data.

Mandatory Disclosures: You must complete all Florida-mandated disclosures (Radon, Lead-Based Paint, HOA, etc.). Failure to provide these may result in listing suspension without a refund.

Photos: You must provide photos that meet MLS quality standards and for which you own the copyright.
4. Buyer Agency Compensation
Per 2026 National and Florida MLS policies:

Negotiable Fees: You are not required to offer a specific commission to a Buyer’s Agent.

MLS Display: Any offer of compensation or "Seller Concessions" must be handled in accordance with current MLS rules. We will assist in entering the allowed data fields, but the decision on what to offer rests entirely with you.
5. Term, Cancellations, and Refunds

Listing Term: Your listing is active for 6 months from the date of activation.

No Refunds: Once the listing has been processed and submitted to the MLS, the $99 fee is considered earned and is non-refundable.

Cancellations: You may cancel your listing at any time for any reason (e.g., if you decide to take the home off the market).
6. Automated Lead Forwarding
ListWithFlex uses Dialpad and automated email systems to forward buyer leads. While we strive for 100% uptime, Florida Flex Realty is not liable for technical delays or missed notifications from third-party search portals (Zillow/Realtor.com).
7. Limitation of Liability
Florida Flex Realty’s liability is limited to the amount paid for the service ($99). We are not liable for any consequential, incidental, or indirect damages arising from the sale or failure to sell your property.
